Article 1 — Purpose

These terms of use (the "Terms") govern access to and use of the HopRoutine mobile application (the "App") and, where applicable, the related website presenting the App (the "Site").

The App is published by Jérémy Froment, sole proprietor (French micro-enterprise), registered under SIRET 885 302 950 00013 (the "Publisher"). The legal representative is Jérémy Froment, acting as a sole proprietor.

By installing or using the App, you acknowledge that you have read these Terms and accept them without reservation. If you do not accept the Terms, you must not use the App.

Article 2 — Description of the service

HopRoutine provides features that help carry out routines (step lists, timers, visual and sound feedback, avatar customization, etc.), mainly intended for families with young children.

The App may be offered for free and/or with additional paid features (see Article 7). The exact features may change over time; the Publisher strives to keep them consistent overall.

Article 3 — Audience and parental responsibility

A minor may only use the App under the responsibility and supervision of a parent or holder of parental authority (or legal guardian). The parent warrants that they have the authority required to accept these Terms and, where applicable, to authorize any in-app purchase made from the device.

The App does not replace parental judgment, the duty of supervision, or the legal obligations regarding schooling, health or safety that apply to each family.

Article 4 — User account

Unless users are notified of a later change, HopRoutine does not require creating a user account for its main use. Routine data is stored locally on the device as described in the privacy policy.

Article 5 — License

The Publisher grants you a personal, non-exclusive, non-transferable and revocable license to use the App in accordance with these Terms and the store rules (Apple App Store, Google Play).

All intellectual property rights in the App, its name, trademarks, code, graphics and content remain the property of the Publisher or its licensors. No right other than the license to use is granted.

Article 6 — Prohibited conduct

In particular, you may not:

  • use the App for illegal or harmful purposes, or in a way that infringes the rights of third parties;
  • attempt to circumvent security mechanisms, extract the source code (except where permitted by law), carry out unauthorized reverse engineering, or interfere with the operation of servers or third-party services lawfully used;
  • resell, rent, assign or commercially exploit the App without the Publisher's prior written consent.

Article 7 — In-app purchases, "Family Pro" subscriptions and restoring purchases

Some features (for example: more child profiles, parallel routines, or future paid options) may be offered as in-app purchases or subscriptions ("Family Pro" or an equivalent name).

Payments are processed exclusively by Apple or Google, depending on the platform. The Publisher is not a party to the payment contract between you and the store; the store's contractual and billing terms apply in addition to these Terms.

Subscriptions renew automatically until you cancel them in your Apple or Google account settings, unless otherwise stated at the time of purchase.

You can restore your purchases from the App ("Restore purchases" or equivalent) in accordance with the platform rules.

Consumers in the European Union may benefit from specific rights (including, in some cases, a right of withdrawal) under applicable law and store policies: please refer to the information provided by Apple or Google at the time of purchase.

Article 8 — Prices and price changes

Prices for paid offers are those displayed in the App at the time of the order, in the store's currency. The Publisher or the platforms may change prices for future offers; changes affecting an ongoing subscription are communicated according to the rules of the relevant store.

Article 9 — Availability and changes

The Publisher strives to keep the App available but does not guarantee uninterrupted availability. The App may be modified (fixes, updates, features added or removed) for technical, legal or security reasons.

Article 10 — Warranties and limitation of liability

The App is provided "as is" and "as available", to the extent permitted by applicable law. Unless mandatory provisions state otherwise, the Publisher shall not be liable for:

  • indirect or intangible damage (loss of time, stress, loss of opportunity, etc.);
  • damage resulting from misuse of the App, lack of parental supervision, or a malfunction of the hardware, operating system or network;
  • interruptions caused by the stores, telecom operators or force majeure.

In any event, where the Publisher's liability is established by a final decision, the total compensation due for a calendar year may be capped at the amount actually paid by the user to the Publisher through the App during that period (excluding purchases refunded by the store), except in the case of gross negligence or willful misconduct by the Publisher where applicable law so requires.

Article 11 — Termination

You can stop using the App at any time by uninstalling it. Subscriptions are managed and cancelled through your Apple or Google account in accordance with their terms.

The Publisher may suspend or terminate your right to use the App in the event of a serious breach of these Terms, after reasonable notice where required by applicable law.

Article 12 — Third-party links

The App or the Site may contain links to third-party websites (support, stores, documentation). The Publisher has no control over these websites and accepts no responsibility for their content or policies.

Article 13 — Governing law and disputes

Unless mandatory provisions state otherwise, these Terms are governed by French law. In the event of a dispute, and failing an amicable resolution within a reasonable time, jurisdiction lies with the courts of the Publisher's place of business in France, subject to mandatory rules protecting consumers (in particular the jurisdiction of the courts of the consumer's place of residence where consumer law so requires).

The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr/.

Article 14 — Contact

For any question about these Terms: contact@hoproutine.app

Article 15 — Changes to the Terms

The Publisher may amend these Terms to reflect changes to the App or to legal obligations. The date of the latest update is shown at the top of this document. Where required by law or by the stores, a notification or renewed acceptance may be requested in the App.
